CONCERNING
STIPULATION OF THE EXPORT REFERENCE PRICE (HPE) OF CERTAIN EXPORT GOODS

THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA

Attachment

Considering:

• a. that in order to implement the provision in article 3 paragraph (6) of government Regulation No. 35/2005 regarding export levies on certain exported goods, it is necessary to stipulate a regulation of the Minister of trade on stipulation of export check prices of certain exported goods;
• b. that based on above consideration in sub-paragraph a, it is necessary to issue a regulation of the Minister of Trade;

In view of:

• 1. Trade ordinance of 1934 (statute book of 1938 No. 86);
• 2. Law No. 10/1995 concerning Customs Affairs (statute book of 1995 No. 75, supplement to statute book No. 3612);
• 3. Law No. 20/1997 concerning Non-Tax State Revenue (statute book of 1999 No. 30, supplement to statute book No. 3888);
• 4. Government Regulation No. 35/2005 concerning Export Levies on Certain Exported Goods (statute book of 2005 No. 82, supplement to statute book No. 4531);
• 5. Presidential Decree No. 260/1967 concerning Affirmation of the Tasks and Responsibility of the Minister of Trade in the Foreign Trade Sector;
• 6. Presidential Decree No. 187/M/2004 concerning the Establishment of the United Indonesia Cabinet as has already been amended by Presidential Decree No. 171/M/2005;
• 7. Presidential Regulation No. 9/2005 concerning the status, tasks, functions, organizational structures and working arrangements of state ministries as has already been amended several times and the latest by the Presidential of Republic of Indonesia No. 62/2005;
• 8. Presidential Regulation No. 10/2005 concerning Organization Units and Duties of Echelons I of State Ministries of the Republic of Indonesia as has already been amended several times and latest by Presidential Regulation No. 63/2005;
• 9. Decree of the Minister of Industry and Trade No. 558/MPP/KEP/12/1998 and Regulation of the Minister of Trade No. 01/M-DAG/PER/1/2007 concerning Export General Provisions;
• 10. Regulation of the minister of Trade No. 25/M-DAG/PER/12/2005 on Procedures for Stipulation of Export Check Prices of Certain Exported Goods;
• 11. Regulation of the minister of Trade No. 59/M-DAG/KEP/3/2006 dated march 29, 2006 on the Establishment of the Team for Stipulating Export Check Prices (HPE) of Certain Exported Goods;

Observing:

• 1. Result of the coordinating meting With Related Agencies and Associations on April 30, 2007 regarding Stipulation of HPE of Certain Exported Goods in the May 10,2007 – June 9, 2007 period.
• 2. Letter of the Director General of Processing and Marketing of Agriculture Products, Ministry of Agriculture No. 337/PP.220/G/5/07 dated May 2, 2007, concerning Price of Palm Oil and its derivative products for March 2007 as input for HPE of May-June 2007.

REGULATION OF THE MINISTER OF TRADE ON STIPULATION OF EXPORT CHECK PRICES (HPE) OF CERTAIN EXPORTED GOODS

Article 1

The Minister in charge of trading affairs or the appointed official in this case the Director General of Foreign Trade shall stipulate Export Check Prices (HPE) of certain exported goods every month.

Article 2

HPE as intended in Article 1 shall be stipulated by referring to international average prices and/or FOB average prices at ports in Indonesia in one month before the stipulation of HPE.

Article 3

The amount of HPE of wood, rattan, palm, CPO and their derivative products and leather shall be as contained in the attachment to this regulation

Article 4

HPE as set forth in Article 3 shall be the basis for calculating export levies (PE)

Article 5

HPE as intended in article 3 shall apply for one month, starting from May 10,2007 – June 9, 2007.

Article 6

In case of the validity period of HPE stipulated on the basis of this regulation had already expired and the new HPE is yet to be stipulated, HPE as contained in the attachment to this regulation shall remain effective as the basis for calculating PE until new export prices are stipulated

Article 7

With the enforcement of this regulation, the Export Check Prices (HPE) as contained in the Attachment to Regulation of the minister of Trade No. 16/M-DAG/PER/4/2007 on Stipulation of Export Check Prices (HPE) of Certain Exported Goods shall be declared null and void.

For public cognizance, the regulation shall be published in state Gazette of the republic of Indonesia.
